New 'Vento' Bands for 2026/27

New guidance has been issued confirming the updated levels of compensation available in Employment Tribunal claims for injury to feelings, following discrimination or whistleblowing cases. These compensation brackets, commonly known as the “Vento bands” are reviewed annually and are a key consideration in employment law claims across the UK.

The updated figures will apply to claims presented on or after 6 April 2026.

The Vento bands originate from the landmark Court of Appeal case Vento v Chief Constable of West Yorkshire Police (2002), which established guidelines for awarding compensation for non-financial harm—specifically, the emotional impact of discrimination.

Updated Vento Bands for 2026/27

The Presidents of the Employment Tribunals in England & Wales and Scotland have now confirmed the revised compensation ranges, adjusted in line with inflation:

Lower Band: £1,300 – £12,600

This band applies to less serious cases, such as isolated or one-off incidents of discrimination.

Middle Band: £12,600 – £37,700

Used for more serious cases, where the conduct is significant but does not justify the highest level of award.

Upper Band: £37,700 – £62,900

Reserved for the most serious cases, including prolonged or repeated discriminatory behaviour.

Awards exceeding this band are rare and only made in exceptional circumstances.
