Business Leases

We know how vital it is to get everything right from the start, that is why we strongly urge our clients to consult us at the beginning of negotiations so we can provide our input and. therefore, help to smooth the progress of the transaction.

A tenancy or lease exists where someone lets premises to another for a term in return for rent. The term of the letting is usually a number of years.

The expression “business lease” is commonly used to refer to a tenancy of premises used for the purposes of running some kind of business. The premises may be a building, part of a building or even open land, used for example as a temporary car park. The terms “business” as used in this context, does not however include agriculture or farming, where there are a different set of rules and customs.

We can assist with commercial lease items such as:-

  • Forfeiture

  • Guarantors
  • Insurance
  • Landlord’s covenants
  • Landlord’s continuing liability
  • Licence to assign
  • Rent reviews
  • Repairing liability
  • Right to renew
  • Tenants continuing liability

We understand that often businesses do not consult with a Solicitor for fear of large legal bills, by which time any remedy still available is likely to be expensive. We advise early consultation if there is any legislation to be complied with or important legal documents, such as contracts, to be signed.
